1. Agreement to Terms

By accessing or using the Simpori application ("app", "service", or "Simpori"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you do not have permission to access the service.

2. Description of Service

Simpori is a Montessori record-keeping application designed for educational professionals. The service allows users to:

  • Create and manage classes

  • Track student progress

  • Create and manage lesson plans

  • Generate progress reports

  • Export educational records as PDFs

3. User Accounts

3.1 Account Creation

  • You must provide a valid email address and maintain accurate account information

  • You are responsible for maintaining the security of your account credentials

  • You must be 18 years or older to create an account

  • Director accounts must have the authority to act on behalf of their educational institution

  • Teacher accounts must have authorization from their Director to access student information

3.2 Account Types

  • Simpori offers two account types: Director accounts and Teacher accounts.

3.2.1 Director Accounts

Director accounts have full administrative access and can:

  • Create and manage schools

  • Manage subscriptions and billing

  • Create and invite Teacher accounts

  • Create and manage classes

  • Assign teachers to classes

  • Add and manage student records across all classes

  • Create and manage lesson plans

  • Generate and export reports

3.2.2 Teacher Accounts

Teacher accounts are created and invited by Directors and have limited access:

  • Teachers must use a unique invite code provided by a Director to create their account

  • Teachers can only access classes assigned to them by the Director

  • Teachers can view and manage student records within their assigned classes only

  • Teachers can create and manage lesson plans for their assigned classes

  • Teachers can generate and export reports for their assigned students

  • Teachers cannot create or delete schools

  • Teachers cannot manage subscriptions or billing

  • Teachers cannot invite other teachers

  • Teachers cannot access classes not assigned to them

3.3 Invite Codes

  • Directors generate unique invite codes for each Teacher account

  • Invite codes must be kept secure and shared only with the intended teacher

  • Directors are responsible for managing and revoking teacher access

  • Teachers must not share their invite codes with unauthorized individuals

4. Subscription Terms

4.1 Subscription Management

  • Only Director accounts can manage subscriptions and billing

  • Teacher accounts do not have access to subscription or payment features

  • Subscription limits apply to the total number of students and teachers per school

4.2 Free Tier

  • Limited number of students and features:

  • Up to 5 students, no teacher invites, all core record-keeping features.

  • No payment information required

4.3 Paid Subscriptions

Access to increased student and teacher limits through 3 plans:

  • Starter Plan: up to 60 students and 2 teachers - $12USD/month

  • Premium Plan: up to 150 students and 8 teachers - $49USD/month

  • Enterprise Plan: up to 300 students and unlimited teachers - $89USD/month

  • Subscription fees are billed through the App Store or Google Play

  • Prices are subject to change with notice

  • No refunds for partial subscription periods

4.4 Cancellation

  • Directors may cancel their subscription at any time

  • Access continues until the end of the current billing period

  • No refunds for unused subscription time

  • Upon subscription downgrade or cancellation, teacher and student profile access may be limited or removed based on plan limits

5. User Responsibilities

5.1 Acceptable Use

You agree to:

  • Use the service for legitimate educational purposes only

  • Maintain appropriate security measures for your account

  • Comply with all applicable laws and regulations

  • Respect intellectual property rights

5.2 Director-Specific Responsibilities

Directors must:

  • Only invite authorized teachers to their school

  • Properly manage teacher access and remove access when appropriate

  • Ensure teachers have proper authorization to access student information

  • Monitor teacher activity within their school

  • Maintain active subscription to support assigned teacher accounts

5.3 Teacher-Specific Responsibilities

Teachers must:

  • Only use invite codes provided directly by their Director

  • Access only the classes and student information assigned to them

  • Notify their Director of any access issues or concerns

  • Not attempt to access unauthorized data or functionality

5.4 Prohibited Activities

You must not:

  • Share account credentials or invite codes with unauthorized individuals

  • Attempt to access unauthorized parts of the service

  • Use the service for any illegal purposes

  • Interfere with the service's operation

  • Upload malicious content or code

  • Attempt to reverse engineer the app in any way

  • Teachers must not attempt to bypass access restrictions or view unauthorized student data

6. Data and Content

6.1 Your Content

  • You retain rights to content you upload to the service

  • You grant us license to store and process your content to provide the service

  • You are responsible for the accuracy and legality of your content

6.2 Student Data

  • You must comply with all applicable education privacy laws (including FERPA where applicable)

  • Directors must have proper authorization to input student information

  • Directors must ensure teachers have appropriate authorization to access assigned student data

  • Student data must be used only for legitimate educational purposes

  • Directors are responsible for managing appropriate access controls for teachers

6.3 Data Access by Account Type

  • Directors have full access to all data within their school

  • Teachers have access only to data for classes and students assigned to them by the Director

  • Teachers cannot access or view data from classes not assigned to them

7. Intellectual Property

7.1 Our IP Rights

  • The service, including all software, design, and content created by us, is our property

  • Our trademarks and branding may not be used without permission

7.2 Your License

  • We grant you a limited, non-transferable license to use the service

  • This license is conditional on your compliance with these terms

  • For Teacher accounts, this license is additionally conditional on maintaining valid access granted by a Director

8. Liability and Warranties

8.1 Disclaimer of Warranties

The service is provided "as is" without warranties of any kind, either express or implied.

8.2 Limitation of Liability

  • We are not liable for any indirect, incidental, or consequential damages

  • Our total liability shall not exceed the amount paid for the service in the past 12 months

  • Directors are responsible for managing teacher access appropriately

  • We are not liable for unauthorized access resulting from shared credentials or invite codes

9. Service Availability and Changes

9.1 Service Availability

  • We strive to maintain service availability but do not guarantee uninterrupted access

  • We may perform maintenance or updates that temporarily suspend access

9.2 Changes to Service

We reserve the right to:

  • Modify or discontinue features

  • Update the app and require users to install updates

  • Change subscription terms with notice

  • Modify account type capabilities or restrictions

10. Termination

10.1 Your Right to Terminate

  • You may stop using the service at any time

  • Directors and Teachers may delete their account through the app's settings

10.2 Our Right to Terminate

We may suspend or terminate your access if:

  • You violate these terms

  • You misuse the service

  • We are required to do so by law

10.3 Effect of Termination

  • When a Director account is terminated, all associated Teacher accounts lose access

  • When a Teacher account is terminated or access is revoked, the teacher loses access to all school data

  • Directors should remove teacher access before a teacher leaves the institution

11. Export of Data

  • Directors may export school data (student lesson plans and learning progress reports across all classes) in PDF format

  • Teachers may export data for their assigned classes in PDF format

  • You are responsible for exporting your data before account deletion

  • We may retain anonymized data after account deletion

12. Governing Law

These terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

13. Changes to Terms

  • We may modify these terms at any time

  • We will notify users of significant changes

  • Continued use of the service constitutes acceptance of modified terms
